Terms & Disclaimer
DozeDoc is being built as a record-keeping, reporting, and billing tool for anaesthetists. It is not a medical device. It does not provide clinical decision support, dosing recommendations, or diagnoses, and must not be used as a substitute for clinical judgement or the official medical record. You remain solely responsible for the care of your patients and for the accuracy of anything billed under your provider number.
These terms (the “Terms”) are a binding agreement between you and DozeDoc Pty Ltd (“DozeDoc”, “we”, “us”). By joining the alpha waitlist or, when the app exists, by creating an account or using the DozeDoc website or app (the “Service”), you agree to be bound by them. The Service today consists of this website and the waitlist form; the app itself is in build and not yet available.
1. Who can use DozeDoc
DozeDoc is being built for medical practitioners in Australia — anaesthetists, anaesthesia trainees, and other practitioners who use ECLIPSE billing. By signing up you confirm that you are at least 18 years old, that you hold valid AHPRA registration where applicable, and that any professional registration details you give us are accurate.
2. Alpha service
DozeDoc is currently in pre-alpha — what exists today is this website and a waitlist form. The alpha cohort, once it opens, will be six to ten anaesthetists across a mix of practice types and career stages, for a four-week trial. We may invite, limit, or revoke access at our discretion to manage capacity and quality during the alpha.
Once the app is in use, features may change, break, or disappear without notice. You should keep an independent record of any cases you log until we formally release version 1.0.
3. Your account
You are responsible for keeping your login credentials confidential and for everything that happens under your account. Tell us straight away at legal@dozedoc.com if you suspect unauthorised use.
4. Acceptable use
You agree to:
- Only submit ECLIPSE claims for services you actually rendered, using MBS items you are eligible to bill;
- Only issue patient invoices for services rendered by you as the treating practitioner, or by a practitioner on whose behalf you have authority to bill;
- Only enter patient information into DozeDoc to the extent necessary for the clinical record and any associated billing or invoicing — and only with appropriate lawful authority;
- Not reverse-engineer, scrape, or interfere with the Service, or attempt to access another user's data;
- Not use the Service to break any law, infringe anyone's rights, or generate misleading professional records.
We may suspend or terminate accounts that breach these rules, normally after giving you notice and a chance to put things right.
5. Your content
You retain ownership of the cases, notes, billing data, and other content you put into DozeDoc (“Your Content”). You grant us a limited licence to host, copy, transmit, back up, and display Your Content for the sole purpose of providing the Service to you and submitting the claims and invoices you authorise. We do not use Your Content to train machine-learning models, and we do not sell it to anyone.
6. Fees
DozeDoc will offer three tiers:
- Logbook only — the ANZCA-compliant logbook;
- Logbook + billing — adds ECLIPSE billing and patient invoicing;
- Logbook + billing + CPD — adds the CPD evidence and reporting tier.
Pricing will be decided after alpha feedback and communicated by email at least 30 days before any change to a paid account takes effect. Alpha cohort members receive free lifetime access to the logbook tier and a substantial lifetime discount on the billing tier when it launches.
Fees, when introduced, will be inclusive of GST. You can cancel a paid subscription at any time from your account; access continues until the end of the current billing period and we do not refund part-months.
7. Our intellectual property
The DozeDoc name, logo, app, website, designs, and underlying code belong to DozeDoc Pty Ltd. Nothing in these Terms gives you a right to use them other than as needed to use the Service.
8. Disclaimer — DozeDoc is not a medical device
DozeDoc is a record-keeping, reporting, and billing tool. It exists to help you capture pre-op, intra-op, and post-op information once, and to generate the artefacts that fall out of that single record — the hospital printout, the ECLIPSE claim, the patient invoice, the logbook entry, and the CPD evidence.
DozeDoc is not a medical device. It is not registered with the Therapeutic Goods Administration (TGA) and is not intended to be used:
- to diagnose, prevent, monitor, treat, or alleviate any disease;
- to support clinical decisions in real time;
- to calculate drug doses for administration to a patient;
- as the official medical record of any patient encounter.
Any clinical guidance referenced inside DozeDoc (ANZCA categories, drug dictionaries, etc.) is provided for context only and may be incomplete or out of date. Always check the primary source. You, as the treating clinician, remain solely responsible for the care you provide.
9. Billing and invoicing on your behalf
When you use the billing tier, DozeDoc transmits ECLIPSE claims to Medicare and to Australian private health funds at your direction, and issues patient invoices on your behalf. DozeDoc is not your billing agent in a fiduciary sense — we transmit what you submit. You are responsible for:
- the accuracy of any item billed under your provider number;
- the eligibility of the services rendered for the MBS items you select;
- complying with Medicare, Services Australia, and the relevant health fund's rules in force at the time of billing;
- responding to audits, reviews, or recovery actions by Medicare, Services Australia, or any health fund.
DozeDoc does not provide financial, tax, or billing advice. Where DozeDoc displays MBS items, fund rules, gap arrangements, or fee suggestions, that material is provided for context only and may be incomplete or out of date.
10. Warranties
The Service is provided on an “as is” and “as available” basis. Except for guarantees we cannot lawfully exclude (including the consumer guarantees under the Australian Consumer Law), we make no warranties about the Service — including that it will be uninterrupted, error-free, or fit for any particular purpose.
11. Liability
Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be lawfully excluded. Subject to that:
- To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the Service is limited to the fees you have paid us in the 12 months before the event that gave rise to the claim, or AUD $100, whichever is greater.
- We are not liable for indirect, consequential, special, or punitive damages, loss of profits, loss of revenue, or loss of data, however caused.
- We are not liable for any clinical outcome, adverse event, or patient harm. You acknowledge that DozeDoc is a record-keeping and billing tool only and that clinical responsibility sits with you.
- We are not liable for billing decisions you make, for items you choose to bill, or for any audit, recovery, or other action a payer takes in response to a claim you have submitted through the Service.
12. Indemnity
You agree to indemnify DozeDoc against any third-party claim arising out of your breach of these Terms, your misuse of the Service, your entry of patient information into the Service without lawful authority, or any claim you submit through the Service for services you did not render or for items you were not eligible to bill.
13. Termination
You can close your account at any time from your settings or by emailing us. We can suspend or terminate your access if you materially breach these Terms, with notice where reasonably practical. On termination you can export Your Content for 30 days before it is deleted in line with our Privacy Policy.
14. Governing law
These Terms are governed by the laws of Western Australia, Australia. You and we both submit to the non-exclusive jurisdiction of the courts of Western Australia.
15. Changes
We may update these Terms from time to time. If a change is material, we will email account holders at least 14 days before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
